Tyranny of Trademarks

A federal judge has ruled in favor of Jerry Falwell, declaring that "falwell.com", a site devoted to criticism of Jerry Falwell, is misusing the trademark "Falwell," which is owned by Jerry Falwell.
[Judge] Hilton said the site's operator, Christopher Lamparello, intended to divert people from the Jerry Falwell Ministries' Web site "with the direct intent to tarnish or disparage" Falwell. He also ruled that Lamparello, of New York, sought to make a profit by selling a book on the site via a link to Amazon.com.
Freedom of speech is rolling in its grave.

That should have nothing to do with it, Mr. Falwell. The court system should have nothing to say about whether the person in posession of the URL is personally opposed to your particular delusions, but whether or not the posession of said URL constitutes a violation of a supposed copyright or trademark. What the fuck.
